A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration detention.
